AbstractThis chapter is about a utopian vision. It concerns an attempt in Vienna at UNCITRAL Working Group III to adapt lessons learnt from the WTO Dispute Settlement System in Geneva in midst of an on-going backlash against the investor-State dispute settlement system, and the fact that by December 2019 the WTO Appellate Body had come to a stand-still as a new decade was about to begin. To adapt a broken system—for that at the time of writing is what the WTO DSS has become—to other purposes is simply remarkable. A utopian proposal or project may be idealistic while still being achievable in practice. But utopianism can also serve as a rebuke. Utopian imaginings are political projects, and one might ask what kind of a political project this is. “In Europe, you cannot swing anything around without hitting an institution.”
